BURBANK ( KTLA) — A judge has dismissed the so-called “airport applesauce” case involving a woman who scuffled with a TSA agent at Bob Hope International Airport in Burbank.
The misdemeanor battery charge against Nadine Hayes was dropped on Monday.
Hayes was accused of hitting a TSA agent who tried to take away a cooler filled with applesauce and other snacks for her 93-year-old mother in April 2009.
Hayes said she had gotten prior permission from the TSA to take the items on the plane.
When the screener gave her a hard time about the cooler, she grew frustrated and a tug-of-war ensued with a TSA agent.
The incident was captured on airport security video.
Hayes was handcuffed and arrested.
She and her mother, who had been traveling to Nashville for a wedding, missed their flight.
Hayes has been fighting a legal battle in the case ever since and refused to accept a plea deal.
She denies striking the TSA agent on the arm but admits to making “a very big scene.”
Hayes is still facing a $2,500 fine from the TSA but says she will fight it on behalf of her mother who passed away earlier this year.
“One of her favorite sayings would be ‘That’s my baby.’ And I think that my mom is saying ‘That’s my baby’ right now,” Hayes told KTLA.
